Security Camera Policy

Purpose

The Berkeley Public Library uses cameras for the safety and security of its patrons, staff, and property. The library utilizes its security cameras, which provide real-time surveillance, to discourage unlawful or inappropriate behavior and activities. When necessary, the library's cameras may provide assistance to law enforcement in prosecuting illegal activity, while adhering to applicable federal, stat, and local law regarding the confidentiality of library records.

Security cameras are not a guarantee of safety nor will they be continuously monitored, therefore, the public and staff should take appropriate precautions for their safety and for the security of their personal property. The library is not responsible for the loss of property or personal injury. 

Location of Cameras

Cameras are placed in public areas determined by the library to best establish a secure environment. Cameras may be placed in both the interior and exterior of the building. Cameras will not be placed in areas where individuals have a reasonable expectation of privacy, such as restrooms. 

Public Notice

The library shall post signs at the entrance giving notice of the use of security cameras for monitoring activity in public areas of the library property. The Library does not routinely monitor live or recorded footage. Recorded footage is only available for a limited time based on the amount of content. 

Access to Footage

Designated staff shall have access to real-time footage. The general public will not be allowed to view live security camera footage but may request copies of recorded footage pursuant to FOIA (see below). Law enforcement will be allowed access to live or recorded footage pursuant to a subpoena, court order, or as required by law, such as in situations involving imminent danger to public health and safety. 

FOIA

Recorded footage may be requested by the general public, subject to the Freedom of Information Act (5 ILCS 140/1, et seq. "FOIA") and may be released subject to any applicable exemptions. All requests should be made in writing and will be submitted to the library' Freedom of Information Officer for review and response.
